TERMS OF SERVICE FOR THE OCCULT ONLINE STORE

§ 1 GENERAL PROVISIONS
1.1. These Terms of Service define the rules for the services provided by Izabela Gaś De Filippo, based in Cieszyn, 43-400, Wiosenna 13, NIP 5481011355, REGON 070568105, hereinafter referred to as the "Service Provider." 1.2. These Terms of Service regulate the rights and obligations of the Service Provider and Users utilizing the online store available at occult.com.pl. 1.3. The Service Provider can be contacted via email at occult.kom@gmail.com or by phone at 660314075. 1.4. Using the online store services implies acceptance of these Terms of Service.

§ 2 DEFINITIONS
2.1. Service Provider – [company name] conducting business at [company address], providing electronic services via the online store. 2.2. User – any individual, legal entity, or organizational unit without legal personality using the services provided by the Service Provider. 2.3. Services – services provided by the Service Provider through the online store, including the sale of goods and products offered by the store. 2.4. Service Agreement – an agreement between the Service Provider and the User concluded upon the commencement of using the online store services, in accordance with these Terms.

§ 3 SCOPE AND TYPE OF SERVICES PROVIDED
3.1. The Service Provider provides electronic services, enabling Users to place orders for goods available in the online store and use the store's functionalities. 3.2. To use the services, the following minimum technical requirements must be met: a) Internet access, b) A web browser that supports cookies, c) An active email account. 3.3. The Service Provider reserves the right to make changes to the online store's offer and to temporarily suspend the store's operation for maintenance or modernization purposes.

§ 4 CONCLUSION OF THE AGREEMENT
4.1. The agreement for electronic service provision is concluded when the User begins using the online store, which includes: a) Creating a user account on the website, b) Placing an order without the need to create an account, c) Signing up for the newsletter. 4.2. The sales agreement for goods between the Service Provider and the User is concluded when the Service Provider confirms the acceptance of the order. 4.3. The User has the right to withdraw from the sales agreement within 14 days from the receipt of the goods, without giving a reason, in accordance with the Act of May 30, 2014, on Consumer Rights.

§ 5 USER RIGHTS AND OBLIGATIONS
5.1. The User is obliged to use the services in accordance with applicable law, good manners, and the provisions of these Terms of Service. 5.2. The User is required to provide truthful and up-to-date personal data when placing an order or creating a user account. 5.3. The User has the right to: a) Place orders in the online store, b) Withdraw from the agreement within 14 days, c) Submit complaints regarding purchased goods.

§ 6 SERVICE PROVIDER'S RIGHTS AND OBLIGATIONS
6.1. The Service Provider undertakes to provide services in accordance with these Terms and applicable laws. 6.2. The Service Provider is obligated to deliver ordered goods to the User free of defects. 6.3. The Service Provider reserves the right to remove the User's account or limit access to services in case of violation of these Terms of Service or applicable law by the User.

§ 7 WITHDRAWAL FROM THE CONTRACT

7.1. A consumer user has the right to withdraw from the electronic services contract without giving a reason within 14 days from the date of conclusion of the contract, in accordance with the Act on Consumer Rights of May 30, 2014.

7.2. To exercise the right of withdrawal, the User must inform the Service Provider of their decision by submitting an appropriate statement in writing or electronically.

7.3. The User may withdraw from the sales contract for the goods within 14 days from the day of receiving the goods, without giving a reason. The goods should be returned in an undamaged condition, without signs of use.

§ 8 COMPLAINTS

8.1. The User has the right to submit a complaint regarding the services provided or the purchased goods. Complaints should be submitted in writing or electronically to the address occult.kom@gmail.com.

8.2. The Service Provider will consider the complaint within 14 days from the date of receipt. The User will be informed of the outcome of the complaint procedure in writing or electronically.

8.3. In the event of a positive outcome, the Service Provider agrees to remedy the issue by delivering new goods, repairing defective goods, or refunding the payment.

§ 9 PERSONAL DATA PROTECTION

9.1. The Service Provider is the controller of personal data processed in connection with the provision of electronic services.

9.2. Personal data is processed for the purpose of fulfilling orders and providing services, in accordance with the Privacy Policy and applicable laws, including Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).

9.3. The User has the right to access their personal data, correct it, request its deletion, or restrict its processing.

§ 10 FINAL PROVISIONS

10.1. The Service Provider reserves the right to amend these Terms of Service. The User will be informed of any changes on the store's website.

10.2. Amendments to the Terms of Service come into effect 7 days after their publication on the store's website. The changes do not affect orders placed before their implementation.

10.3. Matters not covered by these Terms of Service are governed by Polish law.
